Selling hemp-derived products is challenging.
Selling ingestible human or animal products derived from hemp is still illegal in the eyes of the FDA. And no matter whether converted, synthesized, isomerized, or whatever creative term is utilized in the marketing or on the packaging conversions such as Delta 8 THC, Delta 10 THC, HHC, THC-O Acetate are not “naturally occurring” in the hemp plant and are therefore considered to be “synthetics” and flat illegal in the eyes of the US DEA.
Just because everyone is doing it, and just because companies claim these products are “from legally grown hemp” and “safe for consumption” does not make them legal to sell.
The lack of current law enforcement activities does not mean that any of these products are “legal in all 50 states” as many companies claim.
Delta 8, for instance, has seen more states outlaw it than allow it to be regulated. Because the FDA first approved CBD as a drug, they cannot see a path to approving CBD or other hemp derived cannabinoids for regulated use in consumable products.
Again, in the eyes of the FDA, if you can smoke it or put it in your body then it is not legal.
But here we find ourselves in a market that seems to have no shortage of converted, synthesized, psychoactive molecules being sold openly in nearly every ingestible or smokable form imaginable. As distributors and retailers, if we don’t offer these options to our customers, they can just drive down the street and buy what they are looking for elsewhere. It may not be a good product. It may not even be a safe product. But they will find something to satisfy their immediate need.
